By accessing or using OmniHero ("the Service"), operated at omnihero.co.uk and app.omnihero.co.uk, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.
OmniHero is a multi-tenant email marketing platform that enables users to create, send, and track email campaigns using Amazon Simple Email Service (SES). The Service includes email composition, contact management, campaign analytics, automation, and related tools.
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access to your account.

You retain ownership of all data you upload to the Service, including contact lists, email content, and campaign data. By using the Service, you grant us a limited licence to process this data solely for the purpose of providing the Service.
You are solely responsible for ensuring that you have lawful consent to email the contacts you upload and that your email content complies with applicable laws.
The Service uses Amazon SES for email delivery. While we implement best practices for deliverability (DKIM, SPF, bounce handling, complaint processing), we do not guarantee that every email will reach the recipient's inbox. Deliverability depends on factors including your content, list quality, and recipient mail server policies.
Paid plans are billed monthly via Stripe. You authorise us to charge your payment method on file for the applicable subscription fees. Amazon SES sending costs are billed separately by AWS to your own AWS account.
You may cancel your subscription at any time from the Billing page. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods.
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability. We will provide reasonable notice of planned maintenance where possible.
To the maximum extent permitted by law, OmniHero shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless OmniHero, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We may suspend or terminate your account if you violate these Terms, engage in abusive sending practices, or if required by law. Upon termination, your right to use the Service ceases immediately. You may export your data before termination.
We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service at least 14 days before they take effect. Your continued use of the Service after changes constitutes acceptance.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
